These Terms of Service (“Terms”) govern your access to and use of TrailMind, operated by TrailMind (“we,” “our,” or “us”). By using our website or services, you agree to these Terms. 1. Acceptance of Terms
By accessing or using TrailMind, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated here by reference. If you do not agree, do not use TrailMind.
We may update these Terms from time to time. Continued use of the service after changes take effect constitutes acceptance of the revised Terms.
2. Eligibility
You must be at least 13 years old to use TrailMind. If you are between 13 and 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
By using TrailMind, you represent that you have the legal capacity to enter into a binding agreement and are not prohibited from using the service under applicable law.
3. Your Account
Registration. You may create an account with an email address and password, or by signing in with Google. You agree to provide accurate, current, and complete information and to keep it up to date.
Account security. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. Notify us immediately at legal@trailmind.app if you suspect unauthorized access.
One account per person. Accounts are for individual use. You may not share your account or create multiple accounts to circumvent restrictions.
4. Permitted Use
TrailMind grants you a limited, non-exclusive, non-transferable, revocable license to access and use the service for personal, non-commercial purposes — specifically, to discover trails, get AI-powered recommendations, read and write trail reviews, and plan outdoor activities.
5. Prohibited Use
You agree not to:
- Scrape, crawl, or systematically extract data from TrailMind without our written permission
- Use the service to build a competing product or service
- Submit false, misleading, or defamatory trail reviews or content
- Impersonate another person or misrepresent your affiliation with any entity
- Attempt to gain unauthorized access to our systems, other users’ accounts, or non-public areas of the site
- Transmit malware, spam, or any code that could disrupt or damage the service
- Use the AI assistant to generate harmful, illegal, or deceptive content
- Violate any applicable local, state, national, or international law or regulation
We reserve the right to suspend or terminate accounts that violate these rules.
6. AI & Trail Information
TrailMind uses artificial intelligence to generate trail recommendations, descriptions, and answers to your questions. Please be aware of the following:
AI outputs are not guaranteed to be accurate. Trail conditions, distances, difficulty ratings, and access information change over time. AI-generated content may be outdated, incomplete, or incorrect. Always verify critical information with official land management agencies before heading out.
Not a substitute for proper preparation. Trail recommendations are a starting point, not a safety guarantee. You are responsible for assessing your own fitness, experience, and the current conditions of any trail you choose to hike.
Weather data is informational only. Live weather shown on trail pages is sourced from third-party APIs and may not reflect actual on-trail conditions.
7. User Content
Your content. You retain ownership of reviews, ratings, and other content you submit (“User Content”). By posting User Content, you grant TrailMind a worldwide, royalty-free, non-exclusive license to use, display, reproduce, and distribute that content within the service and for promotional purposes.
Content standards. User Content must be honest, relevant, and respectful. You must not post content that is false, defamatory, obscene, harassing, infringing, or otherwise unlawful. We reserve the right to remove content that violates these standards.
No compensation. You are not entitled to any payment or compensation for User Content you submit.
8. Intellectual Property
TrailMind and its original content, features, and functionality — including the design, code, logos, and AI models we develop — are owned by TrailMind and protected by copyright, trademark, and other intellectual property laws.
Trail data sourced from OpenStreetMap is used under the Open Database License (ODbL). We comply with its attribution and share-alike requirements.
You may not copy, reproduce, modify, or distribute any part of TrailMind without our prior written consent.
9. Third-Party Services
TrailMind integrates with third-party services including OpenStreetMap, Open-Meteo, Mapbox, and Google OAuth. Your use of those services is governed by their respective terms and privacy policies. We are not responsible for the content, availability, or practices of any third-party service.
Links to external websites or resources are provided for convenience. We do not endorse and are not responsible for the content of external sites.
10. Disclaimers
TrailMind is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.
We do not warrant that the service will be uninterrupted, error-free, or free of viruses or other harmful components. Trail information, AI recommendations, and weather data are provided for informational purposes and may not reflect current on-the-ground conditions.
Hiking involves inherent risk. TrailMind is an information tool. We are not responsible for injuries, accidents, property damage, or other harm arising from your decision to hike any trail.
11. Limitation of Liability
To the fullest extent permitted by law, TrailMind and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of data, personal injury, or property damage — arising out of or related to your use of (or inability to use) the service, even if advised of the possibility of such damages.
Our total liability to you for any claim arising from these Terms or your use of TrailMind shall not exceed the amount you paid us in the twelve months preceding the claim, or $50 USD, whichever is greater.
Some jurisdictions do not allow limitation of liability for certain damages; in those jurisdictions our liability is limited to the maximum extent permitted by law.
12. Indemnification
You agree to indemnify, defend, and hold harmless TrailMind and its affiliates, officers, and employees from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from: (a) your use of the service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any third-party rights.
13. Termination
By you. You may delete your account at any time from your profile settings. Upon deletion, we will remove your personal data in accordance with our Privacy Policy.
By us. We may suspend or terminate your access at any time, with or without notice, for violation of these Terms, conduct that harms other users or the service, or for any other reason at our discretion. We will make reasonable efforts to notify you when practical.
Upon termination, your right to use TrailMind ceases immediately. Sections that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and indemnification — will survive.
14. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict-of-law provisions. Any dispute arising from these Terms or your use of TrailMind shall be subject to the exclusive jurisdiction of the state and federal courts located in San Francisco County, California.
If you are located in a jurisdiction where this choice of law is not enforceable, the laws of your jurisdiction shall apply only to the extent required.
15. Changes to These Terms
We may revise these Terms at any time. When we make material changes, we will update the “Last updated” date at the top of this page and, where appropriate, notify you by email or with a notice on the site. We encourage you to review these Terms periodically.
Your continued use of TrailMind after revised Terms take effect constitutes your acceptance of the changes.
